BY USING THIS SITE YOU ACCEPT ALL TERMS AND CONDITIONS OF THIS AGREEMENT. If you disagree with any of the Terms or our Privacy Policy, please do not use this website or purchase any services, classes or products.

The following agreement (the “Agreement”) contains the terms and conditions that govern your use of the Website(s) and our Service(s) (as defined below). This Agreement describes your rights and responsibilities, as well as what you can expect from the Website(s) and our Service(s).

Sufi Center East, also known as the Farm of Peace, with the website at farmofpeace.org, (known as the “Website” or “We” hereinafter) owns and operates the Website and reserves the right to add, delete, and/or modify any of the terms and conditions contained in this Agreement at any time and in its sole discretion, by posting a change notice or a new agreement on the Website,so please check this page periodically for changes. In the event of substantive changes to this Agreement, the new terms will be posted to the Website, and you may also be notified by email.

If any modification is unacceptable to you, we ask you not to use the Website and our Services. Your express consent or continued use of the Website or our Services following the posting of a change notice or new Agreement on the Website will constitute binding acceptance of the changes.

GENERAL TERMS

By participating in any Sufi Center East / Farm of Peace activity, you understand and agree that:

  1. Our online presence, including website and social media, is only to be used to promote our religious teachings, programs, activities in a positive way, and may not be used for any other purpose.
  2. Sufi Center East (SCE) is a 501(c)3 nonprofit based at the Farm of Peace (FOP), 1212 Haven Lane, Warfordsburg, PA, 17267.
  3. As a nonprofit, SCE-FOP has no “ownership” as such. The board acts as the legal owner.
  4. Donors and volunteers are much appreciated, we could not do what we do without you! You recognize that donating or volunteering is a gift without a tangible return.  Donating and volunteering do not grant any rights, governance privileges or share in ownership.
  5. Our primary purpose is religious education, specifically promoting Shaddhuliyya Sufism as taught by our Guide “Sidi”, Sa’id Mohammed al-Jamal ar-Rifai ash-Shaddhuli, who left the material world in November 2015. He remains available to us through his many books and his spirit, and the teachers who learned from him.
  6. Sufi Center East is board governed as required by law, and will follow all laws and regulations that apply to any part of our operation.  There is no person or role at SCE that is “above” or “outside” the governance of the board of directors.
  7. Operational management of all activities, paid staff and volunteers is under the supervision of an executive director or equivalent, (“ED”) hired by and reporting only to, the board of directors. 
  8. Our facilities, equipment, social media, Internet, email accounts and drives are for nonprofit use only, including those allocated with a personal name. Individual emails are intended for easier communication with nonprofit tasks only. The board and/or ED may, for management purposes, review any farmofpeace.org or farmofpeace.com email account and associated Google drives.
  9. Staff or volunteers (whether organized in committees or circles, or not), have no autonomy regarding actions or spending other than that granted in writing to those involved, and are obligated to follow all policies, budgets and operating procedures.
  10. No one may acquire or dispose of farm assets, spend funds not in an approved budget, or make agreements or sign contracts, other than the board or ED, without specific written permission from the ED, board chair or treasurer.
  11. All staff and volunteers are required to sign a Liability Waiver, Media Release and Emergency Contact form once each calendar year, and to inform the admin office if any of their information changes via email: admin@farmofpeace.org.
  12. Using our facility and volunteering here is a privilege, with no special rights for any person or group. Using our facilities and the names Sufi Center East and Farm of Peace are allowed only for activities in support of our mission.  
  13. Sufi Center East is not intended to be a cult, and the board of directors discourages cult-like behavior.
  14. No weapons may be kept on the property, other than one 22-caliber single-shot weapon for wildlife problems, which must be licensed and kept locked up when not in use.
  15. Hunting on the property must be by written agreement signed by the ED, good for one season at a time, limited to the “back 40” tree stand, and issued to only one household at a time.
  16. Any event advertised at our retreat center may be moved to the another on-farm venue if registration is more or less than expected.
  17. Personal retreat bookings generally require a 1-night nonrefundable payment to guarantee the reservation.  Those who cancel will have one year to use that amount as a credit for a future booking. No-shows (who fail to cancel) will have their deposit recategorized as a donation.  Expired credits are considered a donation to our center and are tax-deductible the year they expire.
  18. Group retreat bookings shall have contracts that specify the deposit amount, the cancelation window and the non-refundable portion of the deposit.
  19. Our retreat center rates and program fees are subject to change and our website may not be the current price for new bookings. The current price will be given by a staff member. Once a reservation is made, the rate quoted for that stay will be honored.
  20. We are a drug- and alcohol-free property per Islamic guidelines. We also do not allow pork products anywhere on our property. in any of our facilities.
  21. As a religious nonprofit we are exempt from ADA and service animal requirements. We also do not allow animals in our buildings because of the allergens.  Please make arrangements for your pets or service animals before coming to the Farm.  

PRIVACY POLICY

We are committed to protecting your privacy and security and have explained in detail the steps we take to do so. We control this site from Pennsylvania. We do not represent that materials on the site are appropriate or available for use in other locations. Persons who choose to access this site from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable.

What information do We collect?

When you add your name to our Website’s email list, you will be asked to enter your name and email address. When you purchase our Services from the website, you will be asked for your name, phone number, email and credit card information. At all other times, you are able to visit our site anonymously.

We use this information to process your transaction and your information will never be sold, exchanged, transferred or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested.

You always have the right to request information about your stored data, its origin, its recipients, and the purpose of its collection at no charge. You also have the right to request that it be corrected, blocked, or deleted. You can contact us at any time using the address given in this legal notice if you have further questions about the issue of privacy and data protection.

TERMS FOR WEBSITE USE

Prohibited Use. You may not cause harm to the Website or our Services. Specifically, but not by way of limitation, you may not:

    1. interfere with the Website and/or our Services by using viruses or any other programs or technology designed to disrupt or damage any software or hardware;
    2. modify, create derivative works from, reverse engineer, decompile or disassemble any technology used to provide the Website or our Services;
    3. use a robot, spider or other device or process to monitor the activity on or copy pages from the Website and/or our Services, except in the operation or use of an internet “search engine”, hit counters or similar technology;
    4. collect electronic mail addresses or other information from third parties by using the Website and/or our Services;
    5. impersonate another person or entity;
    6. engage in any activity that interferes with another user’s ability to use or enjoy the Website and/or our Services; 
    7. assist or encourage any third party in engaging in any activity prohibited by this Agreement;
    8. co-brand the Website or our Services;
    9. frame the Website and/or our Services; or
    10. hyperlink to the Website and/or our Services, without the express prior written permission of an authorized representative of the Website at farmofpeace.org.

Privacy Policy. By entering into this Agreement, you agree to our collection, use and disclosure of your personal information in accordance with the Privacy Policy.

Ordering Policies. If you purchase any of our Services, you agree that your use of the Service is limited by this Agreement as well.

RESERVATION OF RIGHTS

  1. Monitoring. We reserve the right but do not assume the obligation, to monitor transactions and communications that occur through the Website and/or Service. If We determine, in our sole and absolute discretion, that you or another Website user has or will breach a term or condition of this Agreement or that such transaction or communication is inappropriate, we may cancel such transaction or take any other action to restrict access to or the availability of any material that may be considered objectionable, without any liability to you or any third party.
  2. Modification of the Service. We may modify the Website and/or our Services at any time with or without notice to you and will incur no liability for doing so.
  3. Ownership. All work undertaken by volunteers or staff that result in tangible products, including written material, recordings, photographs, handouts or notebooks, are the property of Sufi Center East and may be used to promote our religion and programs, unless a written agreement limiting such use is signed by the ED before such work is done.

ETIQUETTE

We ask that you respect the Website and our community. Your conduct when using the Website and our Services should be guided by common sense and basic etiquette.  To further these common goals, you agree not to:

  1. Disparage the products or services of any company or individual in public, instead directing your concerns to an appropriate director or manager.
  2. Harass, threaten, or deliberately embarrass anyone, verbally or in writing; or otherwise behave inappropriately, including verbal or physical aggression.
  3. Speak or act against the nonprofit’s best interests.
  4. Speak or write negative, false statements (defamation) harming the reputation of the nonprofit and its officers. This is serious and, if groundless, may result in prosecution.
  5. Impersonate or represent a false relationship with Farm of Peace / Sufi Center East, or other related professionals.
  6. Link to or post content not allowed on the Website.
  7. Solicit a user’s password or other account information.
  8. Harvest user information for any purpose.
  9. Use racially or ethnically offensive language; discuss or incite illegal activity; use explicit/obscene language; or solicit/post sexually explicit images.
  10. Post anything that you do not have the legal right to post; and
  11. Violate any law, or make any untrue or misleading statement;

Complaints: Complaints about the board or any volunteer or staff member should be first directed in private to the ED. Complaints about the ED should be directed privately to the board chair. 

ONLINE SUBMISSIONS

  1. Your Submissions. When you submit questions, comments, suggestions, ideas, message board postings, material submitted via web forms, contest entries, communications or any other information (“Submissions”), you grant us an unrestricted license to use such Submissions for any purpose, including without limitation marketing and other promotional purposes and the right to sublicense. You agree that We will have no obligation to keep any Submissions confidential. You will not bring a claim against us based on “moral rights” or the likes arising from our use of a Submission.
  2. Submissions by Others. We do not control the content posted by third parties and, as such, do not guarantee the accuracy, integrity, or quality of such content. You understand that by using the Website and/or our Services, you may be exposed to content that is offensive, indecent, or objectionable. Under no circumstances will We be liable in any way for any content, including, but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Website and/or our Services by third parties.

REPRESENTATIONS AND WARRANTIES

Mutual Representations and Warranties. Each party represents to the other that:

  1. the party has the full power and authority to enter into and perform under this Agreement,
  2. execution and performance of this Agreement does not constitute a breach of, or conflict with, any other agreement or arrangement by which the party is bound, and
  3. the terms of this Agreement are a legal, valid, and binding obligation of the party entering into this Agreement, enforceable in accordance with these terms and conditions.

Represntations By You. You represent and warrant to us that, in your use of the Website and/or our Services, you:

  1. will not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other legal rights of any third party;
  2. will comply with all applicable laws, rules, and regulations;
  3. will not disrupt or damage any software or hardware; and 
  4. you will provide correct, current, and complete billing and contact information.

DISCLAIMERS AND EXCLUSIONS

Disclaimer of warranties. We provide the website, our services, and all content on an “as is” and “as available” basis. We do not represent or warrant that the website, our services, or website content, or use thereof: (i) will be uninterrupted, (ii) will be free of inaccuracies or errors, (iii) will meet your requirements, or (iv) will operate in the configuration or with the hardware or software you use. We make no warranties other than those made expressly in this agreement, and hereby disclaim any and all implied warranties, including without limitation, warranties of fitness for a particular purpose, merchantability, and non-infringement.

Exclusion of damages. We will not be liable to you or any third party for any consequential, incidental, indirect, punitive or special damages (including damages relating to lost profits, lost data or loss of goodwill) arising out of, relating to or connected with the use of the website and/or our services, based on any cause of action, even if advised of the possibility of such damages.

Limitation of liability. In no event will our liability in connection with your use of the website and/or our services exceed the lesser of (i) the amount paid to us by you during the six months immediately preceding the event that gives rise to such liability, or (ii) one hundred dollars ($100).

The income disclaimer posted on our website is incorporated herein by reference and you hereby represent that you have read and understood it.

INDEMNIFICATION

You hereby indemnify and hold us and our employees, representatives, agents, affiliates, directors, officers, managers and shareholders (the “Parties” harmless from any damage, loss, or expense (including without limitation, attorneys’ fees and costs) incurred in connection with any third-party claim, demand or action (“Claim”) brought against any of the Parties alleging that you have breached any of provision in this Agreement through any act or omission. If you have to indemnify us under this section, we will have the right to control the defense, settlement, and resolution of any Claim at your sole expense. You may not settle or otherwise resolve any Claim without our express written permission.

TERMINATION

Termination. You agree that, under certain circumstances and without prior notice, we may suspend or terminate your use of the Website and/or our Services, including without limitation, if We believe, in our sole and absolute discretion, that you have breached a term of this Agreement. You acknowledge and agree that all suspensions and terminations shall be made in our sole discretion and that We shall not be liable to you or any other party for said suspension and/or termination.

Survival. Upon termination, your license to use the Website, our Services, and everything accessible by and/or through the Website and/or our Services shall terminate and the remainder of this Agreement shall survive indefinitely unless and until we choose to terminate them.

INTELLECTUAL PROPERTY

We respect the intellectual property of others, and we ask our users to do the same. We may, in appropriate circumstances and at our discretion, terminate service to users who infringe the intellectual property rights of others. Provide the following required information (i) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (ii) a description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work; (iii) identification of the URL or other specific location on the Website where the material that you claim is infringing is located; (iv) your address, telephone number, and email address; (v) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. MISCELLANEOUS

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.

LIMITATIONS TO USE are affected by a number of factors over which we have no control.

Limitations to Use of Website and other Services:

  1. When sites are suspended, IPs are blacklisted, due to use of bad plugins, updates not being performed, spamming, etc., we are not liable and no monetary compensation will be made.
  2. We will only knowingly provide our Services to parties that can lawfully enter into and form contracts under applicable law. The Website and our Services are not for children under the age of 18 and any such use is prohibited.
  3. You must comply with all of the terms and conditions of this Agreement, the applicable agreements and policies referred to below, and all applicable laws, regulations, and rules when you use the Website and our Services.
  4. Your License to Use the Website and our Services.
  5. We own or license all intellectual property and other rights, title, and interest in and to the Website, our Services, and the materials accessible on and/or through the Website and our Services, except as expressly provided for in this Agreement. For example, and without limitation, we own trademarks, copyrights, and certain technology used in providing our Services. You will not acquire any right, title or interest therein under this Agreement or otherwise unless expressly provided for herein.
  6. Third-Party Services. We may provide links on the Website to other websites that are not affiliated with, under the control of, or otherwise maintained by us, and may use third parties to provide certain services accessible through the Website. We do not control those third parties or their services, and you agree that We will not be liable to you in any way for your use of such services. These third parties may have their own terms of use and other policies. You must comply with such terms and policies as well as this Agreement when you use these services. If any such terms or policies conflict with our Agreement, agreements or policies, you must comply with our Agreement, agreements, or policies, as applicable. We do not endorse or make any representations or warranties about third party sites or any information, software, or other products or services found there.
